Supply of Products, Information or Services Contract Details
By displaying products on our web site is an opportunity to purchase products at prices and conditions as detailed in our sales conditions. No contract will exist until such time as we send a confirmation e mail confirming the order is accepted and payment is made in full by you. This e mail is confirmation of Fountains & Decor Ltd acceptance of your order to buy goods at prices and conditions in the order confirmation e mail. We reserve the right to withdraw from a potential contract at any time prior to acceptance and it also applies in cases of error or inaccuracy regarding goods or services or descriptions and availability and the order. We reserve the right to change prices and conditions at any time without notice any such changes will be deemed to be immediately effective
Fountains & Decor Ltd does not guarantee the accuracy or reliability of any or all of the information contained in this web site either warranties, suitability, representations, accuracy or fit for purpose.
Payment in full will be debited to credit cards before shipping of goods.
Our policy is to pursue through the legal system any person found to be using a false name or invalid credit card to purchase products from the Fountains & Decor Ltd web site.
Fountains & Decor Ltd will deliver goods globally and we will endeavour to deliver goods as quickly as possible and stated. We expect deliveries in the ROI to be within 48 hours maximum for speedy delivery and within 7 days for delivery by standard post. For lost or delayed deliveries we require 14 to 21 days from the date of posting from the confirmation e mail of dispatch to carry out a trace
For orders within the ROI we use the National Postal service An Post and DPD parcel delivery services.
For orders outside the ROI we use An Post and DPD for shipping to the UK and mainland Europe.
For orders outside the ROI and mainland Europe we use DHL and or FEDEX.
All goods will be shipped to the billing address unless otherwise agreed in advance.
All orders are shipped within 24 hours of your shipping confirmation e mail of your order. Generally most goods are received by the customer within 2 to 5 working days. On rare occasions it may take longer due to delays in the delivery service company which unfortunately is out of our control. We will always endeavour to ensure a prompt and efficient delivery service is maintained. Large orders will be split in to multiple packages for handling reasons and might be delivered in more than one delivery.
Lost or Misplaced Deliveries
On rare occasions a parcel may be delayed or lost by the delivery service company due to an internal error by the delivery company. A lost delivery is deemed to be 15 working days after the date of dispatch from our warehouse. You will be asked to complete a lost delivery declaration form and your claim cannot be processed until this form is returned correctly and fully completed. A false declaration may result in criminal proceedings being brought against you and a prosecution.
All goods will be sent to the billing address given to Fountains & Decor Ltd when the order is being placed. The customer must check the address is correct. We cannot accept claims for a refund or replacement in such cases whereby the customer has given the wrong information to Fountains & Decor Ltd
In the event of a lost or damaged delivery when you have paid for a registered delivery we reserve the right to refund the cost of the lost items or send replacements at no extra charge this decision is entirely at our discretion. When you have chosen free delivery we will either refund the price of the items by credit card refund less an administration fee of 10% of the cost of the product or we may send replacement products less postage costs.
Returns & Replacements
Should you receive incorrect or faulty goods they can be returned to us under our returns policy conditions. Goods will only be accepted back for credit in the original unopened packaging and the product has not been used. Should you have difficulty completing the returns form which we will send to you by e mail or post you can also contact us by telephone at the number given under the Customer Service section. All goods returned to Fountains & Decor Ltd will be fully inspected for damage and authenticity. Should Fountains & Decor Ltd discover the product defect or authenticity is not as a result of our making we will not refund, replace or refund the costs of the items.
Within 7 days of receipt of your order you may return goods to Fountains & Decor Ltd for a refund less delivery costs providing the goods are in saleable condition unopened and unused.
If there is a fault with your product we will offer you a prompt exchange or full refund within 28 days of delivery. We test all returned products and to qualify for a refund or exchange the product must be free of faults as a result of misuse normal wear accident or neglect. Should we decide after testing the returned product the fault is a result of a manufacturers error then we will replace the product free of charge or refund the cost. A returned item which is found to be defective due to misuse or improper handling by the buyer the product will be returned to the buyer.
Non Faulty Goods
Should there be an error in the quantity or type of product Fountains & Decor Ltd delivers to you we will not accept responsibility for such errors if the complaint is not received by us within 7 days of the delivery. Should we receive a complaint under our conditions stated we will:-
Make good any shortage or failure to deliver or
Refund to you to your original method of payment the full amount paid by you less a 10% restocking fee for the products .
We will not accept responsibility or liability for indirect loss or damage arising out of or as a result of a problem you report to Fountains & Decor Ltd under our terms of faulty and returned goods.
In the event you received goods damaged in delivery please contact our customer service department within 14 days of delivery and request a returns authorisation. Goods claimed as damaged outside the 14 days of delivery will not be accepted.
Fountains & Decor Ltd reserves the right to withdraw any item without prior notice.
